When will damages not be awarded for a breach of contract?

Generally, when a party here in Louisiana has had a material breach of contract committed against it, there is a possibility it could be awarded damages for the breach. There are, however, certain circumstances that can limit or completely eliminate a party's ability to be awarded damages for a contract breach. We will now go over a few examples of some circumstances that have this effect under Louisiana law.

There are numerous different types of disputes that can arise between parties that formed a contract with one another. One such type are payment disputes, such as disputes regarding allegations that one party failed to make payments to the other that it was required to under the contract. When a business believes that a party it formed a contract with has violated the terms of the contract by failing to make certain payments, one action it may be able to take to try to get compensation for the missed payments is to bring a breach of contract lawsuit.

When a business interaction leads to a dispute

Interactions between different parties are generally a major part of business. A company often will have interactions with many different parties during the course of business operations, such as suppliers, other businesses within its industry and clients. Also, many interactions can occur within a company as a part of normal business operations, such as interactions between company officials and company employees, interactions between partners in a company and interactions between company shareholders and company officials.
